These Terms of Service ("Terms") govern your use of the FitTally mobile application (the "App"), operated by Reynel Reyes ("FitTally," "we," "us," or "our"). By creating an account or using the App, you agree to these Terms.
You must be at least 13 years old (or the minimum age of digital consent in your country) to use FitTally. By using the app, you confirm you meet this requirement.
You're responsible for keeping your account credentials secure and for all activity that happens under your account. Let us know right away if you believe your account has been accessed without your permission.
FitTally helps you log meals and track calories, macronutrients, and weight over time, including through AI-powered photo analysis of your food.
FitTally is not medical advice. The nutrition estimates FitTally provides — whether from a photo scan, a food database lookup, or your own manual entry — are estimates, not guaranteed measurements. AI-based photo analysis in particular can misidentify foods, misjudge portion sizes, or miss ingredients entirely, including allergens. FitTally is not a substitute for professional medical, nutritional, or dietary advice. If you have a medical condition, food allergy, eating disorder, or other health concern, talk to a qualified healthcare provider before making decisions based on information from this app, and do not rely on FitTally's estimates alone when an inaccurate reading could put your health at risk.
FitTally offers a free tier (including a limited number of AI photo scans per week) and a paid subscription, FitTally Pro, which unlocks additional features. Subscriptions are billed and managed through the Apple App Store. By subscribing, you authorize Apple to charge your Apple ID for the subscription price on a recurring basis until you cancel.
You can manage or cancel your subscription anytime in your Apple ID account settings. Refunds are handled by Apple according to Apple's own refund policies — FitTally does not directly process payments or issue refunds.
We'll always be upfront about what a subscription includes and what happens when your free usage runs out — no surprise charges, no fake urgency, no hidden auto-enrollment.
You agree not to: use FitTally for any unlawful purpose; attempt to interfere with or disrupt the app or its infrastructure; attempt to reverse-engineer or extract the app's source code beyond what's permitted by applicable law; or use the app to upload content that is unlawful, abusive, or violates someone else's rights.
You retain ownership of the photos and information you submit to FitTally. By submitting a photo for AI analysis, you grant us the license needed to process, store, and display it back to you within the app, and to send it to our AI processing provider for analysis as described in our Privacy Policy.
The FitTally app, its design, and its branding are owned by Reynel Reyes and are protected by applicable intellectual property laws. These Terms don't grant you any rights to our trademarks or branding.
You can stop using FitTally and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use of the app poses a risk to FitTally or other users.
FitTally is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, FitTally and its developer are not liable for any indirect, incidental, or consequential damages arising from your use of the app, including damages related to inaccurate nutrition estimates. Nothing in these Terms limits liability where the law doesn't allow it to be limited.
We may update these Terms from time to time. If we make material changes, we'll notify you through the app or by other reasonable means before the changes take effect. Continuing to use FitTally after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
